Unsafe Premises - Misstep Causing Fall
Howard Krepack Wins Substantial Settlement
for 79-Year-Old Accident Victim
Our client, a healthy and independent 79-year-old woman, walked out of a retail establishment, and fell when she stepped from the sidewalk to the parking lot. The curb of the sidewalk was painted the same color as the parking lot asphalt giving our client the false impression that the surfaces were level. As a result of her fall, she suffered a severe left hip fracture and compression fractures in her lower back requiring several surgeries. Prior to this accident, she was quite active, entirely independent, participated in civic and charitable activities, and traveled with her husband. She now is unable to drive, is dependent upon a walker or cane to ambulate and is unable to participate in social and recreational activities.

We proved that the store had created and failed to warn of the dangerous condition created by painting the transition from the sidewalk to the parking lot the same color.
