Calif. Max TTD Rate to Increase to $958.01 in 2009

California's maximum temporary total disability rate will increase to $958.01 in 2009, marking the third year in a row that the state average weekly wage has affected the rate.

The Division of Workers' Compensation (DWC) announced that the increase in the maximum temporary total disability (TTD) rate has increased to an amount equal to the percentage increase in the state average weekly wage (SAWW), pursuant to Labor Code section 4453 (a)(10). For the most recent year, the SAWW increased by about 4.5%, thus requiring the state to increase the TTD rate from $916.60 to $958.01.

The minimum TTD rate also must change according to the SAWW, causing the minimum TTD rate to increase from $137.45 to $143.70.

The new TTD rates take effect on Jan. 1, 2009. The Division also noted that workers with dates of injury on or after Jan. 1, 2003, who are receiving life pensions or permanent total disability benefits may have their rates adjusted based on changes in the SAWW.
